Terms and Conditions

CottageRentals247.com Inc. acts as an agent (The Agent) for the property owner (The Owner),and does not own, or have any responsibility for the maintenance and/or upkeep of the property.

1. General Conditions

    1. As The Agent, CottageRentals247.com Inc. has endeavored to ensure that all information respecting the cottage is current and accurate to the best of our knowledge, and that the cottage is suitable for the intended purpose.The Agent does not warrant or guarantee the quality of the cottage or the fixtures. Please note: The Agent does not own any real estate to help ensure an unbiased opinion of all cottages.
    2. The customer consents to The Agent verifying all credit information and references provided in this application. The Agent may ask for documentation to verify and confirm the booking party’s identification.
    3. All persons listed on the Rental Application or added and approved subsequently by The Agent will be bound by these Booking Conditions. Occupancy of the property is restricted to those names listed on the Application or added subsequently by The Agent.The rental applicant is considered to be the Lead Guest and will assume full responsibility for all members of the rental group throughout the rental period. Information or instructions relating to this rental will be communicated to the Lead Guest only and not to any third- party member of the rental group. It is the responsibility of the Lead Guest to ensure that members of their rental group are aware of and abide by all the terms and conditions contained herein.
    4. The Maximum number of persons using the rental premises shall NOT exceed the number specified for the cottage, on the Cottage Application form. This includes any day visitors and overnight guests. If The maximum number is exceeded, at the discretion of The Agent, the extra guests and/or the customer shall vacate the premises immediately, and will forfeit the balance of the prepaid rental. A penalty 0f up to $250 will be charged for each person over the limit at the discretion of The Agent or The Owner. If The Agent has to make a trip out to the cottage, a fee of $50.00/hr. +( HST), will also be charged.
    5. Renters are not permitted to set up tents, or park camper trailers on the rental premises.
    6. The Guest agrees that the cottage is rented solely for his/her use, and that at no time will they ever sublet the cottage to second party, or allow use to another party that is not listed on the Booking Conditions.
    7. The Guest agrees that the cottage is solely for his/or her recreational holiday purposes and no commercial or other activity shall be carried on.
    8. Check-in and Check-out times are specified on your application form, however these times are subject to change at any time at The Agent or The Owner’s discretion to allow for sufficient changeover time, or repairs. If the check-in or check-out times are adjusted, you would be notified in advance of your rental period. You may arrive at any time after the Check-in time, but must check out by the specified time. Any renters arriving early or checking out late, will be charged up to $250.00/hour +HST.
    9. The Owner and/or The Agent shall be allowed access to the cottage at any reasonable time during any cottage rental occupancy for emergency purposes, report of complaint, or non-compliance with this agreement.
    10. Cottages are checked in between each rental. Upon arriving, ifthe cottage is dirty or damaged, call The Agent immediately (613-332-3340) and make us aware of the situation. This is important so that we can quickly resolve any issues for you (as wel as for subsequent renters), and ensure a quicker resolution for everyone. The Agent will act as an intermediary to ensure issues are dealt with in a timely matter. The Agent cannot resolve complaints after you leave the cottage, or the rental period is over.
    11. If used in excess, the customer shall replace any goods consumed (e.g. dishwasher soap, firewood etc.). Some of the cottages supply a small amount of firewood to get you started, but if you wish to have a campfire for more than one night, please bring some firewood with you. If you use a full tank, or most of a propane tank on the BBQ, you are asked to refill it at your expense, or you will be charged for the cost to refill and travel time to get it to the cottage.
    12. Please be respectful of neighbors, and remember that noise travels much further and is amplified over water. In the event that any unreasonable rowdiness or noise occurs, that leads to repeated complaints by others; The renters shall vacate the premises immediately and forfeit the balance of the prepaid rental.
    13. Smoking, cannabis use, and/or vaping is not permitted in any cottage or screened in area. fI a renter: has been smoking inside; the cottage has a strong smoking odor; and/or smoking debris is found inside, then the customer may be charged a minimum fine of $250.00 and/or the renter may be told to vacate the premises immediately and forfeit the balance of the prepaid rental. No cigarette butts are to be left on the property.
    14. Fireworks are not permitted at any cottage, and shall not be set off in any circumstance.
    15.  We understand pets are a big part of most families. Please abide with the pet restrictions as specified for the cottage, and listed on our website www.CottageRentals247.com. Some cottages do not allow ANY pets, some limit on size, or ask for a non-shedding dog only. i)

    i) For cottages which allow a pet, only one pet is allowed (unless other arrangements were made with you, in writing). The Guest will be charged up to $500.00 per pet for The Agent’s discretion will be charged, and/or The Guest will be asked to remove the extra pets from the property.

    ii) For cottages which limit to a non-shedding dog only, renters are to adhere to this. If a shedding dog (or other pet) is at a cottage which doesn’t allow shedding dog penalty up to $500.00 at The Agent’s discretion will be charged, and/or The Guest will be asked to remove the pet from the property.

    iii) For cottages which Do Not permit ANY pets, renters are to adhere to this. If a pet is at a cottage which doesn’t allow any pets, a charge up to $500.00 at The Agent’s discretion will be charged as well as an admin fee, and/or The Guest will be asked to remove

    the pet from the property.

    1. If a pet is permitted, The Guest will agree to clean up inside and outside after any pet. IfThe Guest does not clean up after a pet at the cottage, a penalty up to$100 +( S T ) will be charged. Also, excessive barking noise or unleashed pets will not be tolerated; you will face a charge up to $100.00 if The Agent and/or The Owner receives a complaint in this regard. Please remember that neighboring cottages may also have pets. Renters are to keep care and control of all pets, and they are to be kept on the cottage property. If The Agent has to make a trip out to the cottage due to a complaint, an admin fee of $50.00/hr.+( HST), will be retained from the damage

    deposit.

    1. The Guest will agree and be responsible to leave the cottage, all furniture, chattels, fittings, and effects on or about the cottage, in the same condition as they found them at the commencement of the cottage rental period, and will take away all garbage/recycling according to dump instructions provided. If garbage/recycling is left at the cottage, a disposal fee and traveling fee will be charged. The customer shall not rearrange the furniture; if the furniture is moved, extra staff may need to be hired to move the items back and a fee will be charged to cover the cost incurred.
    2. Where a cleaning service is not provided; The Guest shall agree and be responsible to leave the cottage clean.Cleaning Supplies etc. provided at the cottage for you. If the cottage is not left in clean condition to the satisfaction of The Agent and/or The Owner, this may result in a cleaning charge of up to $100.00/hour (+ HST) being levied.
    3. Where a cleaning service is provided; The Guest shall follow departure instructions provided by The Owner or The Agent.This cleaning service may/or may not cover a full clean of the cottage. Cleaning service generally covers a 2-hour basicclean, and at some cottages you may have the option of hiring a full cleaning service. If The Agent and/or The Owner are not satisfied with how the cottage is left, this may result in a cleaning charge of up to $100.00/hour (+ HST) being levied.
    4. Common cottage visitors can include the following: mice, ants, squirrels, chipmunks, bats, insects such as black flies, mosquitos, and spiders etc. These creatures are a part of nature. Every precaution is taken to prevent these visitors from entering the cottages. CottageRentals247.com Inc. does not accept such irritations as grounds for cancellation of a rental and/or a refund of monies.
    5. You are coming to a rural area, where power outages can be frequent, but completely out of our control. We do not accept this as grounds for cancellation of a rental and/or a refund of monies. Ifyour power goes out, please call our office immediately(no matter what time) to let us know, and we will do our best to help you through it. Ifit has been out for more than 24 hours, this may include moving you to another available cottage.
    6. The customer shall not be entitled to any refund arising from weather and/or water conditions, changes or fluctuations ni the lake level, conditions at neighboring cottages, or other conditions beyond the control of The Agent and/orThe Property Owner.

    2. Payment

    1. The non-refundable Booking Fee of $85.00 (incl. HST) as wel payment of deposit, are required before The Agent confirms the booking in writing.
    2. Receipt of any deposit prior to The Agent’s written confirmation of the reservation, shall not constitute acceptance of any booking.
    3. Once the Booking Fee has been paid, a down-payment of50% on the total Rental Fee, is required if you are booking more than 30 days prior to the rental period date. Payment may be made by E-Transfer, Visa, MasterCard, Money Order or Cheque. Debit/Visa cards are not accepted. If your application is made within 30 days of the start of your rental period, the total amount is due immediately. We do not accept uncertified Cheques for any payments made within 30 days of arrival. Neversend cash by mail.
    4. Weekend rentals must be paid in full upon booking.
    5. All NSF checks will be subject to a processing fee of $50.00 +HST.
    6. Once a reservation has been accepted by The Agent, the reservation can only be changed to another cottage by treating the original reservation as a cancellation. The terms in Section 4 (a–f) shall apply.
    7. Final balance is due 30 days before the start of the rental period. FinalCheques must be post-dated 30 days prior to your arrival. Non-payment by the due date will be treated as a cancellation and the deposit will be forfeited.

    3. Cottage Telephone & Wi-Fi

    1.  If a cottage telephone is available, The Guest is asked to use a calling card or call collect, unless otherwise stated. If The Guest uses the phone they may be liable for any cost incurred during their stay.
    2.  For cottages with Wi-Fi available, most are on limited data plans and so renters must take caution to not use excessively. If The Agent has been notified that the Wi-Fi data usage has gone over the limit has been used excessively, then The Guest may be charged for the extra fees.

    4. Cancellation Policy

    If The Guest wishes to cancel the rental agreement, he/she must notify The Agent in writing, and the following policy shall apply to all cancellations:

    1.  If The cancellation is60 days or more from beginning of the rental period, The Agent will refund all Rental monies paid less a handling charge of $150 +HST per week booked. If booking is less than 7 days then a$150 +HST would apply. The Booking Fee is non-refundable.
    2.  If The cancellation is made less than 60 days to the commencement of the rental period, The Agent will endeavor to rebook the cottage for the same time period.
    3.  IfThe Agent is successful in rebooking the cottage for the same time period, it will refund all Rental monies paid, less a handling charge of$150 +HST. The Booking Fee is non-refundable.
    4.  If The Agent can only rebook a portion of the rental period, then ti shall refund only that Rental portion less a handling charge of $150

    +HST. The Booking Fee is non-refundable.

    1.  If the Agent is unable to rebook the rental period at all, then all Rental monies paid by TheGuest are forfeited to The Agent, and The Guest is liable for all outstanding monies as stated in the Booking Conditions. The Booking Fee is non-refundable.
    2.  The Agent strives to honor any booking made. fI the Property is damaged,destroyed, uninhabitable, or is unavailable for any other reason out of our control, then The Agent may terminate this agreement by giving written notice to The Guest. Al payments that you have made will be transferred to another cottage rental with The Agent fi you should choose, or refunded, and neither the Property Owners nor The Agent shall have any further liability to you (The Guest)

    5. Accidental Damage Protection Plan (ADPP)

    1.  The ADPP provides The Guest with coverage for accidental damage to the property and/or any personal items of The Owner Up to $1,500 aggregate per stay. The plan provides protection for accidental damage only and does not waive The Guest’s liability for costs resulting from:
    • Negligent or willful behavior by any person accommodated ator visiting the property where the consequences to the property could have been foreseen by a reasonable person, including damage caused by animals belonging to any person accommodated at or visiting the property
    • Cleaning Charges where the property has not been left in a condition as defined in these Booking Conditions
    • Charges relating to the incorrect disposal of garbage
    • Loss or damage to the rented Property in excess of $1,500
    • Overage charges relating to excessive internet usage (as specified on the Cottage Inventory) or long-distance telephone calls
    • Any damage or loss that is not reported to The Agent prior to the property being vacated.
    1. In the event The Agent is not notified prior to The Guest’s departure from the property, a charge for the full cost of repair/replacement will be made on the credit card supplied at the time of booking.
    2.  ADPP is a mandatory charge of$ 7 +HST per night.
    3. The Guest accepts any and all liability for any damage beyond normal wear and tear (for those items not covered by the Accidental Damage Protection Plan)during the term of the Rental Period.

     6. Credit Card Guarantee

    1.  The Lead Guest will provide a valid credit card number and authorize The Agent to charge up to $1,500 ni the event of damage that is deemed non-accidental, pet damage, excessive cleaning charges, internet overage and/or telephone charges, or for damages not reported prior to the property being vacated. In the event that a charge to the credit card is declined, further action will be taken to recover the outstanding amount and a $250 administration fee will be applied, together with any legal fees and additional costs incurred in pursuing a legitimate claim.

    7. Legal Liabilities

    The Guest shall abide by these Booking Conditions and any other additional information and instructions as supplied by The Agent and/or The Owner.

    Notice to all users of properties by CottageRentals247.com Inc. – Exclusion of Liability- Assumption or risk-Jurisdiction. These conditions will affect your legal rights. Please read carefully.

    1. As a condition of the consideration for the use of the cottage property, the customer assumes all risk for personal injury to any persons, including death or property loss resulting from any cause whatsoever, including but not limited to therisks, dangers and hazards of cottage, recreational activities, the use of boats, fireplace/woodstove, stove or barbeque; oras a result of the negligence, breach of contract, or breach of statutory duty of care including any duty of care under the Occupiers Liability Act R.S.0. 1990 C.0.2 on the part of CottageRentals247.com Inc. its employees, agents, representatives, sponsors, successors and assigns (collectively referred to as The Agent). The renter agrees that neither the Property Owners nor CottageRentals247.com Inc., shall be liable for any such personal injury, death or property loss and release the Property Owners and CottageRentals247.com Inc. and waives all claims with respect thereto.
    2. TheGuest accepts full responsibility for the use of the Property and any recreational equipment such as boats, swim mats etc. and agrees to pay for any damage of said equipment, other than for normal wear and tear. The Guest further acknowledges he/she is responsible for ensuring all Boating Regulations are observed, including having required safety equipment in the watercraft, as wel as meeting current OperatorCompetency Requirements.
    3. Each rental property is independently owned and therefore not subject to The Ontario Safe Drinking Water Act (Reg. 170/03). To ensure your safety, each renter is responsible to provide his or her own safe drinking water.
    4. Privacy Code: Use and distribution of information: The Guest consents to the collection, use and disclosure of personal information by The Agent for the purpose of renting the property including, but not limited to: disclosing personal information to prospective cottage owners and others who may assist in the rental of the property, such other use of The Guest’s personal information as is consistent with renting of the property
